Legal Towing of Unauthorized Vehicles
Laws About Tow-Away Zone Signage
Towing a vehicle without the owner’s consent involves signage specifications that must be upheld in order to legally remove the vehicle from the premises. These laws are designed to ensure that private parking spaces are clearly marked. The individual parking their vehicle should be aware of the potential consequences, in order to give them an opportunity to make a better decision.
Below are some of the requirements taken directly from the Florida State Statutes 715.07.
- Signs must be prominently placed at each driveway access or curb cut allowing vehicular access to the property within 10 feet from the road. If there are no curbs or access barriers, the signs must be posted not fewer than one sign for each 25 feet of lot frontage.
- Signs must clearly indicate, in not fewer than 2-inch high, light reflective letters on a contrasting background, that unauthorized vehicles will be towed at the owner’s expense. The words ‘tow-away zone’ must be included on the sign in not fewer than 4-inch high letters.
- Signage must also provide the name and current telephone number of the towing company removing the vehicles from the property.
- The sign structure must be permanently installed with the words ‘tow-away zone’ not fewer than 3 feet and not more than 6 feet above ground level.
- Signage must be continuously maintained on the property for not fewer than 24-hours before the towing or removal of any vehicles.
Vehicle Owner Rights
The vehicle owner has the right to information about their vehicle; which company towed their vehicle, where it is being stored, and what fees to expect. Stonewall Towing & Recovery contacts the local police department or sheriff within 30 minutes of the tow and provides them with all required information.
When a vehicle owner notices their car is missing, they should be able to quickly and easily locate the contact information of the towing service. The trucks and towing equipment must also prominently display the company name, address and contact phone number.
